Did the court discuss at all whether there is room for applying passing off principles, considering that the EU regulation on quality schemes for agricultural products and foodstuffs (No. 1151/2012) has created a comprehensive regime for protecting GIs? After all, the CJEU has held in C-478/07, Budejovicky Budvar (on the regulation's predecessor): "The conclusion must be drawn that the aim of Regulation No 510/2006 is not to establish, alongside national rules which may continue to exist, an additional system of protection for qualified geographical indications, like, for example, that introduced by Council Regulation (EC) No 40/94 of 20 December 1993 on the Community trade mark (OJ 1994 L 11, p. 1), but to provide a uniform and exhaustive system of protection for such indications."Tim Engelhardthttp://www.jbb.denoreply@blogger.com
